1. Uso de YouTube:
1. El propósito y el carácter del uso del material, incluso si dicho uso es de
naturaleza comercial o si responde a objetivos educativos sin fines de
lucro.
Los tribunales suelen centrarse en determinar si el uso "transforma" el contenido
original. Es decir, si se agrega una nueva expresión o significado al original, o si
simplemente se copia el original.
2. La naturaleza del material protegido por derechos de autor.
El uso de material proveniente de obras principalmente fácticas tiene más
probabilidades de ser legítimo que el uso de obras puramente ficcionales.
3. La cantidad y sustancia de la parte utilizada en relación con la totalidad
de la obra protegida por derechos de autor.
El tomar prestadas pequeñas porciones del material de una obra original tiene
más probabilidades de considerarse un uso legítimo de dicho material que el
tomar prestadas grandes porciones. Sin embargo, incluso el uso de una parte
pequeña puede considerarse contrario al uso legítimo en algunas situaciones, si
dicha parte constituye el "núcleo" de la obra.
4. El efecto del uso en el mercado potencial o el valor del material
protegido por derechos de autor.
Los usos que dañan la capacidad del titular de los derechos de autor para obtener
beneficios de su obra original tienen menos probabilidades de considerarse usos
legítimos. En ocasiones, los tribunales han hecho excepciones según este factor
en casos que involucran parodias.
2. Uso de Flicker:
flickr es una red social, que permite compartir
fotografías, comentar las imágenes y añadir
información sobre la ubicación de las mismas.
Recientemente flickr, ha cambiado su diseño, dándole
más importancia a las imágenes, la novedad más
interesante del nuevo flickr es el aumento de
capacidad, que alcanza 1 TB de manera gratuita. En las
opciones de pago podremos quitar la publicidad o
doblar la capacidad a 2 TB.
Una empresa puede obtener grandes beneficios de
flick, la primera y la más obvia, utilizar flickr como
banco de imágenes para utilizarlas cuando las necesite,
además puede sacar partido de muchas otras maneras.
