4. ¿Quién establece las vedas?
Las vedas de pesca las establece la DIPESCA
(que es la autoridad para administrar los
recursos pesqueros), estas son emitidas a
través de Acuerdos Ministeriales, los cuales
serán notificados a los interesados y
publicados en el Diario Oficial por lo menos
treinta (30) días antes de su entrada en
vigor.
Who sets the vedas?
The fishing waste is established by the
DIPESCA (which is the authority to administer
fishery resources), these are issued through
Ministerial Agreements, which will be notified
to interested parties and published in the
Official Journal at least thirty (30) days before
their entry into force.

medida decretada por un
ministerio de gobierno. Se
trata de una normativa o de
una regla que dicta un
ministerio de acuerdo a las
facultades que le otorga la
Constitución.

La autoridad competente, fundamentada
en la mejor evidencia técnica y científica
disponible y/o aplicando el criterio de
precaución, podrá establecer vedas para
la pesca de recursos hidrobiológicos,
tanto marinos como continentales para
fortalecer la sostenibilidad del
aprovechamiento de los recursos.

ordenación que establezca UNIPESCA
para el aprovechamiento sostenible de
los recursos pesqueros deberán estar
basados en evidencias científicas.

management measures for the
sustainable use of fisheries resources
shall be based on scientific evidence.

Ordenación. Dentro de las
medidas de ordenación
para la pesca que se
implementen, UNIPESCA
contemplará: 1. Limites
de esfuerzo; 2. Limites de
captura; 3. Medidas
técnicas, tales como,
artes de pesca, tallas
mínimas de captura y
vedas.

Measures. Within the
fisheries management
measures implemented,
UNIPESCA shall include: 1.
Limits of effort; 2.
Capture limits; 3.
Technical measures, such
as fishing gear, minimum
catch sizes and vedas.
9. Articulo 82.
Seguimiento de las medidas de
ordenación. Cuando UNIPESCA
implemente medidas de ordenación
para determinadas especies, bien
con base en la mejor evidencia
científica y técnica disponible o bien
en ejecución del Criterio de
Precaución definido en la Ley,
realizara el seguimiento d esas
especies a fin de examinar su
situación y la eficacia de las medidas
de conservación y administración.
UNIPESCA revisara periódicamente
tales medidas, sobre la base de
cualquier nueva información
científica disponible.
Article 82.
Monitoring of management
measures. Where UNIPESCA
implements management measures
for certain species, either on the
basis of the best available scientific
and technical evidence or in the
implementation of the Precautionary
Criterion defined in the Act, it will
monitor these species in order to
examine their situation and the
effectiveness of conservation and
administration measures. UNIPESCA
will periodically review such
measures, based on any new
scientific information available.
10. Ministerial Agreement
No. 23-2020
Considering: that it is of strict interest of the State and of general
interest, through the Ministry of Agriculture, Livestock and Food to
apply measures necessary for the rational and sustainable use of
hydrobiological resources, being empowered to establish the
conditions for their extraction and marketing.
11. That it is the duty of the Ministry of Agriculture, Livestock and Food, through
the Policy Direction of Fisheries and Aquaculture, to apply extensively the
precautionary criterion in the management of fishery resources in order to
protect them and to preserve the environment, through the establishment
of actions to protect it, through the assurance of the presence of the fish of
the Scaridae family (Loro fish) , Chaetodontidae (Butterfly Fish),
Pomacanthidae (Angel Fish) and Acanthuridae (Surgeon Fish) on reefs.
12. In the exercise of the powers conferred on it by articles 194 of the Constitution
of Guatemala: 27 and 29 of the Law of the Executive Body, Decree No. 114-97
of the Congress of the Republic and its reforms: 78, 79 of the General Law on
Fisheries and Aquaculture, Decree No. 80-2002 of the Congress of the Republic
of Guatemala: 97 of the regulations of the General Law on Fisheries and
Aquaculture , government agreement 223-2005 and 7 of the internal organic
regulations of the Ministry of Agriculture, Livestock and Food, government
agreement number 338-2010.
