servicios prestados por vía electrónica (“los servicios”)

2. Las reglas de localización de los servicios de
telecomunicaciones, radiodifusión y televisión y
servicios prestados por vía electrónica (“los servicios”)
a consumidores finales (B2C) cambian a partir del 1 de
enero de 2015. Las empresas que presten esos servicios
tendrán que determinar exactamente en qué Estado
miembro está ubicado el consumidor final y repercutir e
ingresar el IVA que corresponda
El cambio
Ahora, los servicios referidos prestados a consumidores
finales no empresarios (“clientes”) tributan en el Estado
miembro en el que el prestador de los servicios tenga
su sede.
A partir del 1 de enero de 2015, los servicios
tributarán en el Estado miembro en el que el cliente
esté establecido, tenga su domicilio o residencia
habitual (“ubicación”).
Presunciones en relación con la ubicación
del cliente
Para garantizar una aplicación uniforme de las nuevas
reglas en la UE, el Consejo de la UE ha dictado un
Reglamento de ejecución que especifica dónde debe
considerarse ubicado un cliente.
El Reglamento establece una serie de presunciones
que el prestador de los servicios puede utilizar para
determinar la ubicación del cliente.
• Por ejemplo, si los servicios se prestan en sitios
tales como una cabina telefónica, zona WIFI,
cibercafé, restaurante o vestíbulo de un hotel, en
los que se requiere la presencia física del cliente, se
presumirá que la ubicación del cliente está en ese
lugar, por lo que ahí se gravarán los servicios.
• Si los servicios se prestan a través de una línea fija
terrestre, se presumirá que la ubicación del cliente
es aquella en la que la línea esté instalada.
• En el caso de que se presten a través de redes
móviles, se presumirá que la ubicación del cliente
es el país identificado por el código de teléfono de
la tarjeta SIM.
• En los servicios en los que es necesario usar un
descodificador o una tarjeta de televisión (sin usar
línea fija terrestre), se presumirá que la ubicación
del cliente es el lugar en el que se encuentre el
descodificador, o si no se conoce, el lugar al que se
envió la tarjeta.

The change
Currently, the mentioned services rendered to
customers that are not businessses (“customers”) are
taxed in the Member State in which the supplier is
established.
From 1 January 2015, the services will be taxed in the
Member State in which the customer is established,
has his permanent address or usually resides (“the
customer’s location”).
Presumptions for the location of the
customer
In order to ensure the uniform application of the
new rules in the EU, the Council of the EU has issued
implementing regulations that explain what should be
considered as the customer’s location.
The regulations provide a number of presumptions
that the supplier of the services can use to determine
the customer’s location.
• For example, if the services are provided at a
location such as a telephone box, a wi-fi hot spot,
an internet café, a restaurant or a hotel lobby
where the physical presence of the recipient of
the service at that location is needed, it shall be
presumed that the customer’s location is that
place, and the services shall be taxed there.
• If the services are supplied through a fixed land
line, it shall be presumed that the customer is
located where the line is installed.
• If the services are supplied through mobile
networks, the location of the customer is
presumed to be the country identified by the
country mobile code of the SIM card.
• For services provided through a decoder or similar
device or a viewing card and a fixed land line is not
used, the customer’s location is presumed to be
where that decoder or similar device is located, or
if that place is not known, at the place where the
viewing card is sent.

3. • En cualquier otro caso, se presumirá que la
ubicación del cliente es el lugar que haya
determinado el prestador del servicio basándose
en dos elementos de prueba no contradictorios de
los siguientes:
• Dirección de facturación
• Dirección IP del dispositivo usado por el
cliente o cualquier sistema de geolocalización
• Datos bancarios (lugar en que se encuentra la
cuenta bancaria utilizada para el pago)
• Código de móvil del país almacenado en la
tarjeta SIM
• Ubicación de la línea fija terrestre del cliente a
través de la que se presta el servicio
• Otra información relevante desde el punto de
vista comercial
Los prestadores de los servicios no tienen que aceptar
las presunciones mencionadas necesariamente. Las
presunciones pueden ser refutadas si tienen tres o
más elementos de prueba no contradictorios que
demuestren que la ubicación del cliente está en otro
lugar.
Por su parte, las Administraciones fiscales pueden
refutar cualquiera de las presunciones si hay indicios
de mala utilización o abuso por parte del prestador.
Implicaciones prácticas
Con algunos ejemplos se puede apreciar la
trascendencia práctica del cambio:
1. Una empresa española vende un anti-virus que se
descarga a través de la web, a clientes ubicados
en Francia, Italia y Alemania. La descarga la hacen
los clientes utilizando su línea fija terrestre. La
ubicación del cliente será el lugar en el que la
línea fija terrestre esté instalada. Por ello, a partir
del 1 de enero de 2015 el prestador del servicio
deberá repercutir IVA francés, italiano y alemán
respectivamente a sus clientes.
2. Una empresa española tiene los derechos de un
catálogo de música y vende descargas digitales a
través de internet. Los clientes pagan con tarjeta
de crédito. Los clientes pueden estar en cualquier
lugar del mundo y descargar la música en
cualquier dispositivo móvil. El lugar de ubicación
del cliente podría ser la dirección IP del dispositivo
y el que indique la cuenta bancaria (siempre que
no sean contradictorios). Si el cliente está ubicado
en la UE, el prestador tendrá que repercutir el
IVA del Estado miembro correspondiente con la
dirección IP del dispositivo.
• In all other circumstances, the customer’s location
is presumed to be at the place identified as such
by the supplier on the basis of two items of non-
contradictory evidence from the following list:
• The billing address of the customer
• The internet Protocol (IP) address of the
device used by the customer or any method
of geolocation
• Bank details such as the location of the
customer’s bank account used for payment of
the service
• The Mobile Country code stored on the SIM
card of a device
• The location of the customer’s fixed land line
through which the service is supplied
• Any other commercially relevant information
Suppliers do not necessarily have to accept the above
presumptions. The presumptions can be rebutted if the
supplier has three or more items of non-contradictory
evidence indicating that the customer’s location is
elsewhere.
A tax authority can rebut a presumption where there
are indications of misuse or abuse by the supplier.
Practical implications
With some examples it is possible to understand the
practical importance of the change:
1. A Spanish company sells an anti-virus program to
be downloaded through its website to customers
in France, Italy and Germany. The program is
dowloaded by the customer using the customer’s
fixed land line. The customer is located where
the fixed land line is installed. Therefore, as of 1
January 2015, the supplier should charge VAT in
France, Italy and Germany.
2. A Spanish company owns the rights to a catalogue
of music and sells digital downloads of the
content via internet. Customers pay by credit
card. Customers may be located anywhere in the
world and download the music onto any mobile
device. The location of the customer could be the
IP address of the device and the one indicated
by the bank account (as long as they are not
contradictory). If the customer is located in the EU,
the supplier should charge the VAT of the country
corresponding with the IP address of the device.
