General Note 32 The operating rules of the FTA, most notably the “specific rules of origin” (which will be addressed in detail), have been incorporated into the Harmonized Tariff as General Note 32. Not only does the FTA eliminate barriers to merchandise trade, the agreement has several other objectives, most notably to reduce barriers to investment among the parties, protect intellectual property rights, and address environmental and labor concerns.

You might want to add this to the presentation. “ An originating good is one that meets the general and/or product specific rules of origin set forth in GN32 (b) or (n). The import specialist’s legal guidance when initiating origin verifications is the HTSUS General Note. In this case for the Peruvian U.S. Agreement will be GN32. Then the documentation requested will be based on the claimed criteria. For example, wholly obtained, tariff shift, value content requirement or exclusively from originating materials.

REGLAS DE ORIGIN (b) For the purposes of this note, subject to the provisions of subdivisions (c), (d), (m) and (n) thereof, a good imported into the customs territory of the United States is eligible for treatment as an originating good under the terms of this note if-- (i) the good is a good wholly obtained or produced entirely in the territory of Peru, the United States, or both; (ii) the good was produced entirely in the territory of Peru, the United States, or both, and-- (A) each of the nonoriginating materials used in the production of the good undergoes an applicable change in tariff classification specified in subdivision (n) of this note; or (B) the good otherwise satisfies any applicable regional value content or other requirements specified in subdivision (n) of this note; and the good satisfies all other applicable requirements of this note; or (iii) the good was produced entirely in the territory of Peru, the United States, or both, exclusively from materials described in subdivision (b)(i) or (b)(ii) of this note.
10. Certification: I certify that: The information on this document is true and accurate and I assume the responsibility for proving such representations. I understand that I am liable for any false statements or material omissions made on or in connection with this document; I agree to maintain, and present upon request, documentation necessary to support this certification, and to inform, in writing, all persons to whom the certificate was given of any changes that could affect the accuracy or validity of this certification; The goods originated in the territory of one or more of the Parties, and comply with the origin requirements specified for those goods in the United States-Peru Trade Promotion Agreement. There has been no further production or any other operation outside the territories of the parties, other than unloading, reloading, or any other operation necessary to preserve the good, and goods have remained under customs control. This certification consists of _______ pages, including all attachments.
The essential points of TBT-07-019 are the elements required in order for the documentation to support a claim for preferential tariff treatment based on a trade preference program include: A statement from a person with direct knowledge of the production of the raw material. If a company has factories in several locations and has designated a centralized point of contact for providing this information, CBP will accept the statement from the authorized provider; The address of the actual production facility where the raw material was produced, not a post office (P.O.) box. While the person authorized to sign the affidavit may work from the corporate office or another office facility, the affidavit must show the address where the materials were produced; The name of the contact person legibly printed, and at least one of the following: phone number, fax number, or email address; A description of the goods including fiber content, yarn count, and fabric type, as appropriate, and identifying information such as an invoice or order number.
Once a determination is made, a CBP 29 will be issued to the importer indicating whether the good qualifies as an originating good pursuant to the rules of the agreement. The CF 29 will reference the good, the date of importation, HTS, rule of origin used to qualify the good, and the determination (positive or negative) with the reason for the determination.
