Investment is the undisputed engine of economic growth. Precisely in
response to its multiple benefits, the present edition seeks to greet all those
measures implemented by the State to unlock important investments.
Currently Peru is regarded as having an auspicious macroeconomic outlook,
and hence a wide maneuvering margin that has allowed for prudent
countercyclical policies to confront unfavorable scenarios caused by the
deterioration of the global economy. In figures, between 2002 and 2012 the
average growth of our country has been 6.4%, GDP per capita growth has
been above 50% and poverty rate fell from 48.5% in 2004 to 25.8% by 2012.
Inordertomakesenseoutofthesefigures,itisessentialtoidentifythefactors
responsible for such auspicious results. Both private and public investment
areresponsibleofexpandingtheeconomy.Together,theysumupabout29%
of GDP. As a surprise to many, this has not only benefited direct participants.
Even though private investment makes up 80% of total investment, growth
has contributed to employment, equality of opportunities, and decreasing
extreme poverty and social inclusion.
Our country benefits today from being accredited as a highly attractive
place for investment at a regional and global level. In this context, reforms
are being implemented with short term horizons to make up our large
infrastructure deficit, which currently exceeds US$ 40 billion. Among these
measures, several seek to facilitate investment, boosting greater productivity
and driving business growth, while seeking to dismiss institutional obstacles
at the micro level.
Nevertheless, our macroeconomic figures do not make up for the many gaps
thatcontinuetoplagueourgrowth:alargeinfrastructuredeficit,properlabor
regulation and education to facilitate the transition towards an appropriately
skilled workforce with a greater contribution of value in the production chain:
Furthermore, we need improvements in matters of security and governance,
as well as lessening our dependence on extractive industries.
We must consider the qualitative aspects of our economic growth. It is these
aspects that will provide our country with the necessary tools to achieve
sustained levels of growth and prosperity over time.
Measures of rapid implementation to relieve short-range issues are relevant,
but are certainly not enough to maintain us on the path of current growth
in the long run. Undoubtedly, employment and growth will come from the
execution of projects, but these benefits will be temporary if they do not rely
on structural reforms.
With the same urgency, binding guidelines for the long term should be
implemented to pursue more than short-term relief. Only after a proper
integration and coordination between short and long-term will there be a
true contagion effect among different productive sectors and dynamism will
not be paused during each government transition.
Today we count on high growth rates that grant us a place among the best
performing economies in Latin America. The way this context is handled,
could drive us towards a mere illusory effect of success with an expiration
date, or on the contrary, could be complemented with reforms that enable
competitiveness and aim at boosting our growth tomorrow. The dynamism
of our economy provides an environment that enables the promotion
of structural reforms that grant sustainable quality to our economic
development. As such, it is in our hands to give them the importance they
deserve.
La inversión es el indiscutible motor del crecimiento empresarial y la expan-
sión económica. Precisamente en respuesta a sus múltiples beneficios, es
que la presente edición busca saludar todas aquellas medidas instadas por el
Estado para destrabar inversiones.
En la actualidad son muchos los voceros del auspicioso panorama macro-
económico del Perú, y del amplio margen de maniobra que ha permitido
aplicarpolíticascontracíclicas,afrontandoescenariosdesfavorablesdelaeco-
nomía global. Nuestra realidad macro se ve reflejada en tasas de crecimiento
promedio de 6.4% entre el 2002 y el 2012, un crecimiento del PBI per cápita
de más del 50% y una reducción notable de la pobreza desde 48.5% en el
2004 hasta el 25.8% en el 2012.
Encontramos a la inversión privada y pública como gran timón de la econo-
mía; juntas abarcan alrededor del 29% del PBI. Ello no solo ha beneficiado
a participantes directos del rubro privado, en tanto tal inversión constituye
cerca del 80% de la inversión total, sino que ha asumido un rol fundamental
en materias de empleo, igualdad de oportunidades, caída de la pobreza e
inclusión social.
Sin duda, nuestro país ve grandes beneficios en ser acreditado como una
de las plazas de inversión más atractivas a nivel regional y mundial. Bajo este
contexto,sonmuchaslasmejorasquesevienenejecutandoatravésderefor-
mas con horizontes de corto plazo, y que atenderían en parte el gran déficit
de infraestructura que hoy supera los US$ 40 mil millones. Entre éstas, se en-
cuentran una serie de medidas que en agregado buscan facilitar la inversión,
confiriéndole una mayor productividad e impulsando el crecimiento empre-
sarial; al mismo tiempo que buscan combatir los obstáculos institucionales
a nivel micro.
No obstante, nuestras cifras macroeconómicas no permiten subsanar mu-
chas deficiencias que aún aquejan nuestro crecimiento. Permanecen como
tareas pendientes un gran déficit de infraestructura, una adecuada regula-
ción laboral y una reforma educativa que facilite una fuerza laboral capacita-
da. Asimismo necesitamos mejorar en materias de seguridad e instituciona-
lidad, así como aminorar nuestra dependencia de las industrias extractivas.
Debemos cuestionar los aspectos cualitativos de nuestro crecimiento eco-
nómico. Solo el propio manejo de los mismos, permitiría que nuestro país
cuente con las herramientas necesarias para alcanzar niveles sostenidos de
crecimiento y prosperidad en el tiempo.
Las medidas de rápida ejecución para aliviar problemáticas de corto alcance
sonpertinentes,aunquenosuficientesparamantenernosenlasendadecre-
cimiento actual. Es indudable que generarán empleo y crecimiento basados
en la ejecución de proyectos, pero de no apoyarse en reformas estructurales
de largo plazo sus beneficios serán meramente transitorios.
Con la misma premura, deben idearse directrices vinculantes para el largo
plazo que persigan, más que aliviar aspectos coyunturales, obtener resulta-
dos trascendentales en materias de desarrollo sostenible y una mayor com-
petitividad. Solo a partir de una correcta integración y coordinación entre
ambos enfoques es que se permitiría un verdadero efecto contagio entre
distintos sectores productivos, y cuyo dinamismo no se pausará en cada go-
bierno de turno.
El día de hoy contamos con una de las economías con mejor rendimiento de
América Latina. La manera en la que nos manejemos dentro de este contex-
to, podría dirigirnoshacia un meroefectoilusoriodeéxitocon fecha de cadu-
cidad, o por el contrario, podría complementarse de reformas habilitadoras
de competitividad destinadas a potenciar nuestro crecimiento mañana. El
gran dinamismo de nuestra economía, ofrece un entorno propicio para el
fomento de reformas estructurales que le otorguen la cualidad de sosteni-
bilidad a nuestro desarrollo económico. Queda en nuestras manos darle a
dichas reformas el impulso y prioridad que ameritan.

Speeding Up Processes Associated with
the SNIP (National System for Public
Investments)
In line with license contracts, co-financed
licenses that manage public resources must
adequate to the procedures established in
the ongoing general directives of the SNIP.
Initially,theSNIPdraftedguidelinesthatwere
applicable to all projects executed through
PPPs. However, this was later repealed. We
believe it is convenient to establish a specific
procedure for the formulation, presentation
and evaluation of public investment projects
forco-financedlicenses.Therationalebehind
this proposal is that, in practice, the licensee
is an additional agent and participates in
the formulation process of these projects,
performing tasks that are inherent to the
Formulating Units.
For the case of co-financed licenses with
the obligation of formulating master plans
that are later approved by the competent
State entity or regulator, it is unnecessary

AGILIZAR LAS INVERSIONES
Agilización de los procesos asociados al Sis-
tema Nacional de Inversión Pública (SNIP)
En línea con los contratos de concesión, las
concesiones cofinanciadas que administran
recursos públicos deben de adecuarse al
procedimiento establecido en la Directiva
General del SNIP que se encuentra vigente.
Inicialmente el SNIP planteó lineamientos apli-
cables a proyectos ejecutados a través de APPs.
Sin embargo, este anexo fue derogado poste-
riormente. Creemos conveniente establecer
un procedimiento específico de formulación,
presentación y evaluación de proyectos de in-
versiónpúblicaparaelcasodeconcesionesco-
financiadas.Laracionalidaddeestapropuestaes
queenlaprácticaelconcesionarioesunagente
adicional y participativo del proceso de formu-
lación de estos proyectos, y asume funciones
inherentesdelasUnidadesFormuladoras.
Para el caso de una concesión cofinanciada
cuya obligación es la de formular planes maes-
tros que posteriormente son aprobados por la
entidad estatal o regulador competente, pasar

adendas a contratos vigentes.

must also state explicitly which aspects will
be reformulated or supported. A PIP (Public
InvestmentProject)shouldonlybeobserved
again for reasons that escape the first
evaluation”. This clause must be extended to
Formulating Units.
Withregardstoevaluationperiods,theSNIP’s
directive can only regulate over the OPI. If

das en el perfil. La unificación permitirá simpli-
ficar y agilizar los procesos y reducir el tiempo
paraelotorgamientodelaviabilidad.
Deotrolado,elSNIPregula,atravésdelartículo
13.4 de la directiva vigente, las observaciones
que la Oficina de Programación e Inversiones
(OPI) formula a la evaluación de los documen-
to que el concesionario presenta a través de
la Unidad Formuladora, estableciendo que
“cuando la OPI formule observaciones, debe
pronunciarse de manera explícita sobre todos
los aspectos que deban ser reformulados o
sustentados,nodebiendovolveraobservarun
PIPsinoporrazonessobrevinientesalaprimera
evaluación”.Estacláusuladebedeserextensiva
tambiénalasunidadesformuladoras.
Respecto de los plazos de evaluación, la Direc-
tivadelSNIPsólopuederegularalaOPI. Siana-
lizamos el proceso completo asociado al SNIP
podemos apreciar que igualmente las unida-
des formuladoras revisan y dan su aprobación
alosaspectostécnicos.Esporelloqueconside-

Nevertheless, increasing technical staff in
size will not help if a decentralization of
functions is not done in parallel. Given that

Fortalecimiento del staff técnico
La dotación de personal técnico involucrado
en estas aprobaciones no se ajusta al nivel
de inversiones que se requieren. Sin em-
bargo, el incremento del personal técnico
capacitado no es de gran ayuda si éste no
viene asociado de una desconcentración de
funciones. Siendo que muchas concesiones
se desenvuelven en un sector altamente
especializado, se plantea como alternativa
de solución y agilización la tercerización de
estas funciones a empresas de consultoría
especializadas en dicho sector.
Transferencia de terrenos entre organis-
mos del Estado
La libre disponibilidad de los terrenos ga-
rantiza la ejecución de las obras asociadas
a nuestros planes maestros. El traspaso de
los terrenos de distintos órganos del Estado
resulta fundamental para cumplir con dicho
objetivo. Si bien es cierto que puede existir
la predisposición de los distintos organismos
estatales involucrados en estas transferen-
cias, los plazos para materializar dichas trans-
ferencias son extensos y los procedimientos,
engorrosos.
Adendas a los contratos vigentes
Los contratos por naturaleza son incomple-
tos y perfectibles en el tiempo. El mundo no
es estático sino dinámico. Los organismos
involucrados deben tener la capacidad y vo-
luntaddeadecuarlosmismosalasnecesida-
des y condiciones actuales tal que permitan
agilizar las inversiones.

The free availability of land plots guarantees
the execution of works related to our master
plans. The transfer of land between different
State organisms is fundamental in order to
fulfill said objective. Even though the organs
might be willing to execute these transfers,
time periods and procedures related to this
process are long and cumbersome.
Addenda to Ongoing Contracts
Contracts are naturally incomplete and
perfectible throughout time. The world is
not static, but dynamic. Organisms involved
should have the capacity and determination
to adapt them to the current necessities and
conditions in order to speed up investment
execution.

Studying by candlelight was normal for
those of us in school or college, whether
we did or did not have a connection to
the network. Businesses subsisted thanks
to small electrical generators that provided
them with the energy that the State failed
scandalously to deliver.
The situation with fuels was similar.
Sometimes we had it, more frequently
we didn’t; this, in spite of the fact that
we already knew about Camisea, and
there existed an integrated monopoly
company (as many absent-minded
people still recommend) that, in theory,
was in charge of covering our energetic
needs. Again, the State failed its citizens
tremendously.
Energy was the cornerstone of the reforms
inthe1990s.Itwasdecidedthatthecountry

Estudiar alumbrado por velas era normal
para los que estábamos en el colegio o en
la universidad, tuviéramos o no conexión
a la red. Los comercios subsistían gracias a
pequeños generadores eléctricos que les
proveían de la energía que el Estado fallaba
escandalosamente en entregar.
Similar situación se presentaba en los com-
bustibles. A veces había, más veces no ha-
bía; pese a que ya sabíamos de Camisea, y
contábamos con una empresa monopólica
integrada (como tanto desmemoriado hoy
anhela) que, en teoría, se encargaba de cu-
brir nuestras necesidades energéticas. Nue-
vamente el Estado fracasaba groseramente
con sus ciudadanos.
Las reformas de los noventa tuvieron como
piedra angular a la energía. Se decidió aten-
der las necesidades de energía del país y
para ello se convocó al capital privado. Había
que resolver el problema de la intermiten-
cia en el suministro de energía, crear nueva
oferta y mucha infraestructura faltante. Los

with great coverage at the national level.
Nevertheless, the energy industry confronts
a complex stage, in which projects cannot
be developed in spite of being financially
and economically viable.
Now, it is more important that projects
count not necessarily with the money or
serious sponsors, but with the blessing of
surrounding populations, environmental
or social NGOs, entities from outside the
sector, regional and local governments,
“defense fronts” from a given locality, and
that they abide by an endless number

nectada a la red eléctrica mientras se siguen
incorporando más peruanos a la misma. Igual-
mente,tenemosunareddeexpendiodecom-
bustiblesconunagrancoberturaanivelnacio-
nal. Pese a ello, la industria energética enfrenta
una etapa muy compleja con proyectos que
nopuedenserdesarrolladospeseacontarcon
financiamientooviabilidadeconómica.

What do we propose to do to execute
energyprojectsformorethanUS$26billion?
The following:
1. Rely, once again, on a solid political
willingness to have the necessary
support in developing any energy
project.
2. Elaborate and execute a sector plan
articulated by the private and public
sectors.
3. Elevate capacities in:
State institutions that are linked to
the energy sector, and eliminate
overlapping between them,
maintaining the Ministry of Energy
and Mining as the governing body.

llones de dólares? Lo siguiente:
1. Contar nuevamente con una férrea
voluntad política para el apoyo que
requiere el desarrollo de cualquier pro-
yecto energético.
2. Elaborar y ejecutar un plan sectorial con-
cordadoentreelsectorpúblicoyprivado.
3. Elevar la capacidad de:
Instituciones del Estado que es-
tán vinculadas al sector energía, y
eliminar duplicidades entre ellas.
Manteniendo como ente rector al
Ministerio de Energía y Minas.
Empresas públicas del sector ener-
gía para que desarrollen proyectos
rentables asociadas con privados, y
que no sean utilizadas como com-
plemento de programas sociales.
La Contraloría General de la Repú-
blica para evitar el escrutinio poco
técnico de un sector que por natu-
raleza es muy complejo. Debemos
desterrar el Síndrome Contraloría.
Creo que aún estamos a tiempo, antes de
tener que volver a estar a oscuras o hacer
largas colas en los grifos para darnos cuenta
de cuáles son las prioridades que debemos
tener para desarrollar un proyecto en el sec-
tor energía.

REFORM PACKAGES, GOVERNANCE
AND THE LONGTERM
Paquetitos,paquetazos,institucionalidadyellargoplazo
The reform package introduced by the Ministry
of Economy and Finance (MEF) is an accurate
approach to preventing economic deceleration
in the midst of unfavorable international condi-
tions. At the same time, this strategy is focused
in GDP growth in the short-run: unclogging the
execution of large investment projects. It is im-
portant that structural factors for long-term de-
velopment receive equal attention.
El paquete de reformas impulsado por el MEF es un
loable esfuerzo por que no se deprima el crecimiento
económico en un contexto internacional desfavora-
ble. A su vez, es una estrategia enfocada en el incre-
mento del PBI en el corto plazo: desatorar la ejecución
de grandes proyectos de inversión. Es importante que
los factores estructurales para el desarrollo a largo pla-
zo reciban la misma premura.
País a dos velocidades
Lapriorizacióndelaagilidadeconómicalehava-
lido al Perú ser el único país en la región con un
crecimiento anual superior al 5% en los últimos
veinte años. Hoy, se nos reconoce un manejo
macroeconómicodignodelprimermundo.
En contraste, los demás pilares del desarro-
llo se encuentran gravemente relegados y
cuentan con indicadores propios del África
subsahariana. El Índice de Competitividad
Global nos ubica en las últimas posiciones
de la región en educación, salud, infraes-
tructura, institucionalidad y seguridad. Ello
es consecuencia de la política de desarrollo
que el país sigue desde los noventa.
A principios de aquella década, la economía
peruanaparecíairremediable,yeranecesario
darle prioridad absoluta a un plan de estabi-
lización económica drástico. En esta línea se
desarticula en 1992 el Instituto Nacional de
Planificación, responsable de la asignación
de recursos y diseño de políticas multisec-
toriales de largo plazo. El Viceministerio de
Economía recoge sus principales funciones,
pero con una visión orientada al crecimiento
por eficiencia y en el corto plazo.
Nuestras subsecuentes tasas de crecimiento
altas son principalmente consecuencia de
favorables coyunturas y paquetes orienta-
dos a explotarlas. Algunos ejemplos: la ola
Two-Speed Country
Peru has been the only country in the region
with an annual growth above 5% during
the last twenty years, primarily because
its governments have given priority to
economic agility. Today, the quality of our
macroeconomic management exceeds that
of some of the most advanced economies.
In contrast, all other pillars of Peruvian
development are weak, having indicators
that are comparable to those of most
Sub-Saharan African countries. The Global
Competitiveness Index ranks Peru in the
last positions of the region in education,
health, infrastructure, governance and
security. This is also a consequence of the
development path that the country has
followed since the 1990s.
At the beginning of said decade, there
appeared to be no solution for the Peruvian
economy other than giving absolute priority
to a drastic economic adjustment plan. In
this line, the Institute for National Planning
(INP), responsible for allocating public
resources and designing long-term multi-
sector policy, was dissolved in 1992. Its most
important functions were adopted by the
Viceministry of Economics (VE). However,
in contrast with the INP, the VE is subject to
political rotation, and favors a short-term
vision towards efficiency-driven growth.
Our subsequent growth rates have been
high mainly due to favorable contexts
and packages introduced by economic
authorities to exploit these junctures. Some
examples are: the wave of privatizations
during the early 1990s, the exploitation and
exportation of mineral resources, and the
implementationoflargeinvestmentprojects
in infrastructure. All have been crucial
contributions to the Peruvian GDP, but none
of them have generated conditions for self-
sustaining long-term growth, nor have they
impacted our most important and fragile
pillars of development.
Packages and Band-Aid Solutions
The package that the MEF promulgated
earlier this year reflects how short-term
efficiency-driven growth is given priority
over constructing long-term governance.
In the midst of economic deceleration
in 2013, the MEF published a series of
measures to speed up the administrative
procedures that investment projects must
undergo before they are executed. The
main elements of the package were: 1)
application of sanctions to civil servants
that apply administrative barriers, 2)
application of positive administrative
silence, 3) exoneration of certain permits
and certificates, and 4) the conformation
of a specialized team to track investment
execution in the MEF.

Mostoftheseelementswillactasshort-term
palliatives to deep and structural cleavages
in our State. In the first place, in assuming
that punishing a civil servant will prevent
him/her from placing obstacles, we assume
that we are dealing with an issue of lack of
willingness. The application of a positive
administrative silence, similarly relates
delays in procedures to complaisance
in the public sector. However, we must
consider other limiting factors in the State:
1) incapacity at all levels, and 2) inaction as a
product of fear to political vulnerability.
The speed and quality with which the
public sector executes processes involving
investmentareindirectrelationtoitscapacity.
Increased speed in a context of constant
capacity will mean decreased quality. When
the rigor of processes is affected, the civil
servant is left even more exposed to suits
from the Controllership – national auditing
body. These initiatives, however, are no more
than band-aids to a structural fracture.
Governance Kit
If we demand more and better action
from the State we will need to provide it

Paquetes y parches
La priorización de crecimiento por eficiencia
en el corto plazo sobre generación de insti-
tucionalidad en el largo plazo, se hace evi-
dente en el paquete publicado por el MEF a
mediados de este año.
En el contexto de desaceleración del 2013,
el MEF promulgó un paquete de medidas
para agilizar los procedimientos por los
que deben atravesar los proyectos de in-
versión. Las principales normas establecen:
1) aplicación de sanciones a los funciona-
rios que apliquen barreras administrativas,
2) aplicación del silencio administrativo
positivo, 3) exoneración de autorizaciones
y certificados, y 4) conformación de un
equipo especializado de seguimiento de
la inversión en el MEF.
Al suponer que una posible sanción al fun-
cionario público evitará que éste aplique tra-
bas, se asume una falta de voluntad. La co-
locación del silencio administrativo positivo,
también asocia la prolongación de trámites
con la complacencia en el sector público. Sin
embargo, debemos considerar a otros limi-
tantes estructurales en el funcionamiento
del Estado: 1) incapacidad imperante en to-
dos los niveles, y 2) la inacción como conse-
cuencia de temor a la vulnerabilidad política.
La velocidad y calidad con que el sector
público ejecute los procesos relativos a la
inversión, están en función de su capacidad.
Mayor velocidad en un contexto en el que
no incrementa la capacidad, supone reducir
calidad. Al afectar el rigor de los procesos, el
funcionario queda aún más expuesto a las
denuncias de la Contraloría. Las medidas
implementadas son meros parches sobre
fracturas estructurales.
Botiquín de institucionalidad
Si aumentamos la exigencia al Estado, tam-
bién necesitaremos aumentar su capacidad.
Urgen, por ejemplo, una amplia y profunda
reforma de servicio civil, asignación de pre-

supuesto coherente, y dotación de capaci-
dad tecnológica en el Estado.
Ademásdebemoseliminarlosincentivosalainac-
ción; la Contraloría dispara y paraliza indiscrimina-
damente a funcionarios corruptos y a honrados,
conunatasadeeficienciadetansolo33%.Sedebe
reformar dicho organismo y dotarlo de la capaci-
dad de liderar una lucha contra la corrupción de
manera eficiente, en lugar de sentenciar a cuanto
funcionariosemuestreactivoyconiniciativa.
De la misma manera, la exoneración completa
de trámites y permisos que vuelven más lenta
laejecucióndeproyectos,suponequesonpro-
cesos innecesarios. Debe hacerse cuidadosa
evaluación de la utilidad de cada proceso para
consolidaryprotegeralainversiónysuentorno.
Debe priorizarse la simplificación, fusión, o redi-
seño de procesos antes que su completa elimi-
nación. Esta última medida debe ser reservada
para instancias comprobadamente innecesa-
rias,puespodríaestararriesgándoseelequilibrio
alrededordelainversión.Lapreocupaciónporel
cortoplazonodebeopacarlaimportanciadela
sostenibilidaddenuestrodesarrollo.
Por último, el establecimiento del Equipo
Especializado de Seguimiento a la Inver-
sión en el MEF es una saludable iniciativa.
No obstante, la naturaleza de sus funciones
asignadas requiere un mayor grado de ins-
titucionalidad y autonomía. Su creación y
posición dentro de una gestión ministerial
en particular, lo sujeta a vaivenes políticos y
arriesgan su propia sostenibilidad y la de sus
avances. Sería ideal que este Equipo deven-
gaenlaDefensoríadelInversionistaque,con
un carácter de organismo autónomo como
la Defensoría del Pueblo o el BCR, logre ins-
titucionalizar su autonomía y sostenibilidad.
MEF como eje gravitacional
Actualmente debemos buscar replicar la ins-
titucionalidad que se ha logrado en materia
monetaria en los demás sectores donde la
improvisación es la principal característica. En
el Estado peruano, las instituciones económi-
cas son el eje gravitante y lo demás es peri-
férico. Para muestra un botón: el ministerio
con el más alto ingreso promedio es el MEF,
mientras que los de ingreso promedio más
bajo son los ministerios de Agricultura, Inte-
rior, Justicia, Salud,Transportes yVivienda.
En este contexto, es el MEF a quien le toca
llevar la lanza para la implementación de

and higher technological capacity.
Furthermore, we must eliminate incentives
for inaction. The Controllership fires
indistinctly, paralyzing both corrupt and
honest civil servants, and has an efficiency
rate of only 33%. Said organism must be
reformed and given the necessary capacity
to lead the fight against corruption in an
efficient way, instead of charging every civil
servant that is active and shows initiative.
In the same way, when we eliminate certain
administrative processes and permits that
investment projects have to go through,
we assume that these processes are
unnecessary. A careful evaluation must
be done of the role and efficiency of each
process in consolidating and protecting an
investment and its environment. In making
processes more agile, priority should be
given to simplification, fusion, and redesign.
Complete elimination of a process should
only be for those that have been proved to
be unnecessary, given that this could risk
the equilibrium surrounding an investment.
Preoccupation about the short-term
should not overshadow the importance of
consolidating sustainable development.
At last, establishing the Specialized Team
to Follow-up on Investments in the MEF is
a healthy initiative. Nevertheless, the nature
of its assigned functions requires a higher
degree of autonomy and governance.
Its creation and position within a specific
Ministerial administration hold its progress
and its sustainability to political swings.
It would be ideal that the Team evolved
into a public and autonomous organism
for the defense of investments, such as the

National Ombudsman or the Central Bank.
This would guarantee its sustainability.
MEF as the Gravitational Axis
The governance framework which has
been achieved around monetary policy, for
example, should be reproduced in all other
sectors that are currently characterized
by improvisation. In the Peruvian State,
economic institutions are the gravitational
axis and other sectors are peripheral. Wage
distribution among public offices makes
this evident. The ministry with the highest
averageincomeistheMEF,whileAgriculture,
Internal Security, Justice, Health, Transport,
and Housing, have the lowest averages.
In this context, it is the MEF that leads the
implementation of key reforms such as civil
service reform, health reform, the “General
Labor Law”, or decentralization reform. It is
positive that the duty of pushing forward
such necessary reform is picked up by any
given office in the Government. It is not
positive, however, that such reforms that
affect several ministries are assigned to one
specific ministry.
CrucialStatereforminitiativesarethereforetied
to inter-sector conflicts, political interests and
highrotationamongministries.Consequently,
the most urgent and necessary reforms, have
been repeatedly ill-designed, redesigned,
debated, and delayed throughout several
administrations. This makes evident that the
Governmentlacksacentral,autonomousand
technical organization that can design and
lead long-term reform.
CEPLAN is the Plan
In this line the importance of the CEPLAN
must be reconsidered. Today it is an organ
thatdependsdirectlyonthePresidencyofthe
CouncilofMinisterswithnorelevantauthority
or responsibility. Furthermore, it is the only
national planning body in Latin America
that holds a position below ministries. The
CEPLAN must be an autonomous organism,
such as the Superintendence of Banking and
Insurance (SBS), or the Central Reserve Bank
(BCR).Inaddition,itmustbeahighlytechnical
body, capable of establishing medium and
long-run objectives in the most relegated
sectors for national development; education,
health, infrastructure, and governance.
Complimentarily, it must be capable of

designing and articulating the execution of
the strategies to fulfill said objectives with
other ministries and executive bodies.
Conclusion
It is healthy to enact measures that aim at
speeding up investment execution in order
to maintain the economic expansion rate.
Nevertheless, these are measures oriented
at the short-run, and they must not
overshadow efforts that aim at long-term
governance and structural reforms of the
State. Furthermore, the CEPLAN must be
empowered and be given the capacity to
lead the reform projects that are now led by
theViceministry of Economy. In this way the
high GDP growth rates will be matched by
improvements in our most important but
weak pillars of development.

ción que recoja la bandera de estas reformas
necesarias. No lo es, sin embargo, que estas
reformas que afectan a diversos ministerios e
instancias del Estado, estén encargadas a un
ministerio específico.
Las reformas de Estado esenciales hoy están
sujetas a conflictos intersectoriales, a la po-
litización y a la alta rotación del ambiente
ministerial. Consecuentemente, a lo largo de
diversas administraciones gubernamentales,
las reformas más urgentes y necesarias han
sido mal diseñadas, rediseñadas, debatidas
varias veces, y repetidamente prolongadas.
Ello deja en evidencia el riesgo que significa
que no existan entidades técnicas y estables
que puedan diseñar y dirigir reformas estruc-
turales con proyección a largo plazo.
CEPLAN es el plan
En esta línea debe reconsiderarse la impor-
tancia del CEPLAN en el Estado, pues hoy es
una dependencia de la PCM sin capacida-
des, y la única organización de planificación
estatal en Latinoamérica con una jerarquía
menor a la ministerial. El CEPLAN debe te-
ner el carácter de organismo autónomo que
tiene el BCR o la SBS. Debe ser además un
cuadro altamente técnico y en capacidad de
establecer metas a mediano y largo plazo
en los sectores más relegados del desarrollo
nacional; educación, salud, infraestructura,
institucionalidad. Asimismo debe estar en
capacidad de diseñar y articular la ejecución
de las estrategias para cumplir dichas metas,
con ministerios y organismos ejecutores.
Conclusión
Es saludable procurar no perder el ritmo del
crecimiento económico con normas que prio-
ricen la agilización en la ejecución de grandes
proyectos de inversión. No obstante, estas
medidas orientadas al corto plazo, no deben
opacar los esfuerzos de reformas instituciona-
les y estructurales en el Estado. Más aún, debe
empoderarse al CEPLAN para que pueda estar
en capacidad de liderar los proyectos de refor-
ma de Estado que hoy recaen sobre elVicemi-
nisterio de Economía. De esta manera las altas
tasas de crecimiento del producto podrán ser
acompañadas de similares mejoras en nues-
trospilaresmássensiblesydébiles.

The final month of the year is always a
busy time at the Chamber. We collect a
significant share of our annual revenues
in December and so our fundraising
and finance teams will be working
almost 24/7 to conclude 2013 on a solid
financial footing. I am very optimistic
that we will end the year strongly and
have the resources we will need to
advocate effectively for the business
community in 2014 and beyond.
We will also be busy on the policy
front, working to advance key business
priorities and produce those last
2013 accomplishments—despite a
compressed legislative calendar and
the “hardship conditions” of divided
government.
The House returned from its
Thanksgiving break yesterday and the
Senate will reconvene on December
9. That leaves very few legislative days
available before Congress recesses until
2014. Striking a fiscal year 2014 budget
deal by December 13 in order to avoid
another government shutdown early
next year tops the list of this month’s
congressional priorities. Other time-
sensitive issues such as passing a new
farm bill (which includes the food
stamp program), forestalling large cuts
in Medicare providers’reimbursements,
enacting water resources and national
defense legislation, and in the Senate,
approving the nomination of Janet
Yellen as the next chair of the Federal
Reserve will also consume lawmakers’
attention.
Considering these factors, further
legislative action on immigration reform
will likely be pushed into the New Year.
However, we are continuing to make
steady progress advancing our case
for reform and lining up additional
support. President Obama’s recent
indication that he could support the
House leadership’s preferred approach
of tackling immigration reform in several
bills rather than one comprehensive bill
wasapotentiallyimportantstepforward.
Due to divided government, Congress
and the president are on track to enact
significantly fewer new laws than usual.
According to the Wall Street Journal,
just 52 laws have been passed this
year, compared to 284 from 2011-2013.
While legislative gridlock has indeed
delayed solutions to some pressing
national priorities, gridlock is not always
bad, especially for business. At times,
government inaction is preferable to
bad action. As we work for proactive
reforms in many areas, stopping
provisions that are harmful to the
economic growth and job creation will

A las“siete medidas”(que involucran menores
plazos para los Certificados de Inexistencia de
Restos Arqueológicos y los Estudios de Im-
pacto Ambiental, así como leyes que facilitan
la expropiación de tierras, entre otros), se les
sumó, efectivamente, el seguimiento directo
detreintaproyectosdeinversiónrelevantesyel
levantamientodesustrabas.Así,estegobierno
parecehabercomprendidoqueexistenlimita-
ciones a la inversión pública en sectores como
el de infraestructura, en el que tanto los mon-
tos como el expertise para realizar las obras
hacen que las asociaciones público-privadas
(APP) sean una buena alternativa a la inversión
públicatradicional.
Sin embargo, hace falta saber qué es lo que
trabalainversión,engeneralynoenparticular,
demodoquenosenecesiteunequipo“destra-
bador”cada vez que la economía afronte una
desaceleración, sino que el Perú sea un país en
el que la inversión sea una constante, tanto en
las vacas gordas como en las flacas. Así, es sen-
cillo identificar tres grandes problemas. El pri-
meroestárelacionadoconla(faltade)tomade
decisionesporpartedelaburocracia;elsegun-
do con la descentralización y los recursos que
se transfieren a las regiones; y el tercero con la
inexistencia de una planificación plurianual y
multisectorialenmateriadeinversiones.
Lamentablemente, aunque identificar a los
sospechosos comunes no sea complicado,
proponer soluciones sí lo es, pues se trata de
problemas que se originan en la raíz misma
del sector público y para los que se necesita
mucho apoyo político para lograr una solu-
ción. Por tanto, las soluciones planteadas hasta
ahora por el EEI son no solo pragmáticas, sino
tambiénmeritorias.Peronosedebeperderde
vista que para lograr algo en el largo plazo, es
mejorempezarhoy.
Así, es necesario no solo poner en práctica de
modo transparente la recientemente aproba-
da ley del Servicio Civil, sino además dotar de
herramientas para que los funcionarios puedan
sustentar su toma de decisiones. No existe, por
ejemplo, una base de datos que permita mos-
trar con facilidad los sobrecostos relacionados
con la inversión pública (sobretiempos, falta de
mantenimientodelainfraestructura,problemas
con los contratistas, incrementos de costos, en-
tre otros) que permitan demostrar la razonabili-

projects and of any potential barriers to

seems to have understood that there are

Nevertheless, we still need to realize what
is impeding investments in general and

la remoción de las “trabas”a la inversión, el cual ha to-
mado mayor interés conforme las perspectivas sobre
el PBI para 2013 han ido descendiendo. Desde el des-
pacho del Presidente de la República, luego de algu-
nos lapsus como el intento de compra de la Refinería
La Pampilla, vino el mandato que fue acatado por el
Ministro de Economía, Luis Miguel Castilla, y generó la
creación del Equipo Especial de Seguimiento de las In-
versiones (EEI), liderado por Alonso Segura.

peración interinstitucional. La tarea es titánica,
y es mejor empezarla hoy, en una economía
todavíaencrecimiento.

there is no database that shows extra costs
related to public investment (extra time, lack
of infrastructure maintenance, cost increases,
among others) that show the reasonability
of choosing a PPP. Neither is there ex post
evaluations of public investments.
On the other hand, we must generate
incentives for better investment in the
regions. When we evaluate the spending
efficiency in the local and regional
governments, it’s easy to realize that
centralized planning would have rendered
betterresults.Inthissense,itisimportantto
extend the Works for Taxes scheme so the
private sector can also elaborate technical
files and pre-investment procedures for
subnational governments.
Finally, multiannual and multisector planning
is perhaps the hardest problem to solve.
Having a stronger ProInversion and a scheme
forresults-orientedbudgetswouldbeagood
first step. The task is titanic, and it is better to
start today, in a growing economy.

no debe ser eludido, pues hoy el rol de las
empresas es social, además de empresarial.
Su liderazgo debe estar basado en principios
en lugar de reglas. En la medida que se lleve
a cabo una gestión con buen gobierno cor-
porativo, las empresas podrán lograr avanzar
hacia una menor necesidad de regulación
por parte del Estado que, en muchos casos,
se ejerce de modo asfixiante.
Nuestro país genera un mayor interés inter-
nacional debido a su sostenido crecimiento
económico. Esto modifica el escenario en el
cual se desenvuelven las empresas y el rol
que deben implementar frente al desarrollo
integral. Los públicos modifican sus conduc-
tas en la dinámica socioeconómica y en los
mercados, entonces, se presentan nuevos
desafíos de interacción empresa-usuario,
empresa-colaborador, empresa-Estado. La
confianza aquí tendrá un valor estratégico
y en la medida que todas las empresas se
presenten formales, innovadoras, y con pro-
puestas tangibles. Constituirán el stakehol-
der social e interiorizado al devenir de cada
ciudadano.
Los factores que impulsan la confianza en
los diversos públicos de la empresa son
la consideración en ránkings globales,
la reputación de los ejecutivos o sus de-
mostraciones de innovación, pero estos
factores no son sostenibles por sí solos.
Seguirá siendo importante que la empre-
sa elabore un buen producto y brinde un
servicio de calidad, pero también lo será
que escuche las necesidades de sus clien-
tes y genere un diálogo constante con
ellos y otros grupos.

Cuando reviso los estudios de confianza veo que en la
mayoría de países, la población cree que las empresas
actúan mejor que los gobiernos. Esto, por razones que
pueden ir desde la idea de que las empresas poseen
mayor eficiencia y recursos, así como menor nivel de
corrupción. El Barómetro de la Confianza de Edelman,
mide este delicado aspecto de las relaciones humanas
desde el año 2000. En él observamos que para los pú-
blicos informados (consumidores de medios con edu-
cación universitaria e ingresos por encima del promedio
delmercado)laconfianzaenlasempresassuperapor10
puntos que se tiene en los gobiernos.
When I look over confidence studies, I see that in
the majority of countries, the population believes
that businesses will act better than governments.
Reasons for this include the idea that companies
have higher efficiency and more resources, or lower
levels of corruption. In Edeleman’s Confidence
Barometer, which measures this delicate aspect of
human relations since the year 2000, we can see
that for the informed public (media consumers
with tertiary education and income above the
market average) confidence in businesses exceeds
confidence in governments by 10 points.

The factors that foster confidence in a
business’ target audience are position in

these factors are not sustainable alone. It is
still important that a company elaborates
a good product and gives good-quality
service, but also that it listens to the needs of
its clients and generates a constant dialogue
with them and other groups.
Businesses should follow a management
model that applies transparency in a radical
way, where collaborators are informed of the
objectives, and are allowed to participate in
them. Furthermore, they carry out ethical
business practices in any instance and
operation, as small as it may be.
For all the aforementioned principles, it
is fundamental that communication is
carried out carefully, with precision and
inclusion, so messages are not distorted
and little chance is left for them to be
distorted by those who oppose the social
democratic progress.
As businesses work with a better
understanding of our impacts, out conduct
will be perceived without external noise. It is
a delicate field, because confidence is fragile,
and opinions are volatile. The opportunity
for businesses exists and we can make the
best of it by earning a license to lead, and
leave aside the need of ambiguous and
manipulative extralegal social licenses.

El tratamiento de frío es un proceso que se
aplica a la importación de frutas y vegetales
frescos, a fin de eliminar posibles pestes que
estos productos puedan contener. Consiste
en mantener una temperatura constante de
frío dentro del contenedor durante un perio-
do determinado por la Agencia de Sanidad
Animal yVegetal de Estados Unidos (APHIS).
En el pasado, productos peruanos como
uvas de mesa y arándanos solo podían in-
gresar a Estados Unidos a través de ciertos
puertos del Atlántico Norte. Sin embargo,
el nuevo programa piloto permite que es-
tos productos, una vez completado el tra-
tamiento de frío, puedan ser importados
directamente a Miami. Ello ha permitido la
creación de una nueva ruta de comercio
para este tipo de productos directamente a
Florida y al sudeste de EEUU.
Dentro de este programa, las uvas a ser distri-
buidas en los mercados de la Florida puedan
ser descargadas directamente en Miami. Esto
disminuye el tiempo de distribución, el costo
de transporte terrestre y reduce las huellas de
carbono del producto.

del Departamento de Agricultura de EEUU
(USDA), la Agencia de Aduanas y Protección
deFronteras(CBP)ylaCoalicióndeProductos
Perecibles de la Florida con las entidades lo-

más embarques de uvas programados para
llegar durante ese mes. Una vez ingresado el
producto en el puerto puede ser distribuido

ta al mercado.

abre oportunidades a ambas naciones, y bus-
ca incrementar el comercio bilateral con un
importante socio comercial, como EEUU.

su primer embarque de uvas peruanas. Esto fue parte
del nuevo programa piloto que permite la importación
de productos agrícolas frescos desde el Perú que hayan
completado el tratamiento de frío.

Peruvian grapes last December 1, 2013. This is part
of a new pilot program that allows the importation
of Peruvian fresh agricultural products that have

see that the combined efforts of both
Governments are having results. The
FTA between Peru and the U.S. allows
the possibility of greater access to the
American market for Peruvian products.
Thanks to the efficient cargo handling at the
port of Miami, this product has the potential
to reach to 70 % of the U.S. population
in no longer than four days. This opens
opportunities for both countries, and aims to
increase bilateral trade with a major trading
partner, like the U.S.
Thisnewprogramandtheexchangebetween

for Peruvian producers and exporters, since

In our country, there are many disciplines
in which we are not as successful as we
could be. This is clearly seen in sports and in
business. In the particular case of soccer, we
have been absent from theWorld Cup for 25
years. In the case of businesses we see how
Peruvian companies are less competitive
than foreign ones in our own country. As
a result, our companies get sold to foreign
buyers at low prices.
To be graphical, I ask you to imagine that
UniversitariodeDeportesorAlianzaLimaplayed
in the European leagues. We would need a lot
of luck to win a game. The same happens to
Peruvian companies that as a result of FTAs
competewithcompaniesfromotherleagues.
The chances of being successful are low.
Ideally, we should have the ability to win and
the ability to learn from our mistakes. For
this, however, we first need to be on equal
conditions. This means that our companies
should match those from other leagues
in terms of productivity, discipline, order,
creativity, rigor, research, compromise, and
ability to learn.
Between Peru and the more developed
economies there are sharp contrasts of all
kinds: in the streets, in sports, in business, in
compliance with established norms, in art,
creativity, product development and many
other things. These differences are the result
of our thinking. While developed societies
promote development, ours inhibits it.
These differences are reflected in respect,
competition, work, education, savings, time,
the individual, wealth, justice, innovation,
usefulness, order, cleanliness, punctuality,
and responsibility, among others.
Our society’s way of thinking and acting is
also present in Peruvian companies, and I
believetheyarethereasonwhyweremainfar
from being able to compete with corporate
companies in the medium and long term.
One way to look at these differences is to
do it through the paradigms that shape
the behavior of workers in companies. A
paradigm is a “set of experiences, beliefs
and values that affect the way an individual
perceives reality and the way he responds
to that perception. In order to be able to
compete with first world companies, we
need to adopt behaviors that generate
prosperity. This is achieved by changing the
paradigms that shape their behavior.
The task will not be easy and the main
responsibility lies with the leaders of each
company.
En nuestro país, en muchas disciplinas no
somos tan exitosos como podríamos ser-
lo. Esto se ve claramente en el deporte y a
nivel empresarial. En el caso particular del
fútbol llevamos más de 25 años sin partici-
par en un Mundial. En el caso empresarial
vemos cómo las empresas peruanas son
menos competitivas que las extranjeras en
nuestro propio país. Como consecuencia,
nuestras empresas son vendidas a precios
bajos a empresas extranjeras.
Para ser gráfico, les pido que se imagi-
nen cómo les iría a la “U” o al Alianza si
jugaran en las ligas europeas. No hace
falta tener mucha imaginación, necesi-
taríamos mucha suerte para ganar algún
partido. Lo mismo le sucede a las empre-
sas peruanas que como consecuencia
de los TLC firmados, hoy compiten con
empresas de otras ligas.
Está claro que las posibilidades de ser exito-
sos son bajas. Primero deberíamos tener la
capacidad de ganar y la capacidad de apren-
der de nuestros errores. Pero para que estas
capacidades estén presentes y generen
éxito es necesario que primero estemos en
igualdad de condiciones. Es decir que nues-
tras empresas tengan las mismas condicio-
nes que las empresas de esas ligas en temas
de productividad, disciplina, orden, creativi-

La forma de pensar y actuar de nuestra so-
ciedad está también presente en las empre-
sas peruanas, y son la razón por la que creo
que estamos lejos de poder competir con
empresas de sociedades desarrolladas en el
mediano y largo plazo.
Una forma de ver estas diferencias es
hacerlo a través de los paradigmas que
modelan las conductas de los trabaja-
dores en las empresas. Un paradigma es
un “conjunto de experiencias, creencias y
valores que afectan la forma en que un
individuo percibe la realidad y la forma en
que responde a esa percepción. Para ser
competitivos con empresas del primer
mundo necesitamos adoptar conductas
que generen prosperidad. Esto se logra
cambiando los paradigmas que moldean
sus conductas.
La tarea no será fácil y la responsabilidad
principal está en las gerencias generales de
las empresas.

Our active role earned us an invitation to
the Directive Board, and I had the honor
to chair the Board this year. Once inside,
my company’s obligation to ABE became
to transmit a vision to our partners: ABE
is not only an issue regarding the area
of HR, but all other areas such as Sales,
Logistics, Social Responsibility, Marketing,
and requires commitment from the top
management.
The formalization of employment is an
important factor to ensure the sustainability
ofeconomicgrowth,andwecancontribute
to this goal from the private sector. Does it
seemutopian?Maybe,butitwillceasetobe
when we stop thinking it is and start acting
accordingly. Working to have Peruvian
companies respecting their personnel by
giving them formal employment should
start with our own actions in our business
environment.
Nuestro activo rol nos valió ser invitados
a la Directiva, y este año tuve el honor de
presidirla. Una vez dentro de ella, la obli-
gación de mi empresa para con ABE se
convirtió en una visión a transmitir a los
demás líderes de nuestros asociados: ABE
no es solo un tema del área de RRHH, sino
de todas las demás áreas como Compras,
Logística, Responsabilidad Social, Marke-
ting, y requiere el compromiso de la más
alta gerencia.
La formalización del empleo es un factor
importante para asegurar la sostenibili-
dad del crecimiento económico del país,
y desde el sector privado podemos con-
tribuir con este objetivo. ¿Parece utópi-
co? Tal vez, pero dejará de serlo el día que
cada uno de nosotros piense que no lo es
y empecemos a actuar en consecuencia.
Conseguir que las empresas peruanas
respeten a su personal dándoles empleo
Hace seis años, AmCham invitó a mi empresa a for-
mar parte de ABE. Me interesó, y nos convertimos en
uno de los socios fundadores. Una vez asociados, vi-
mos que además de preocuparnos por nuestra área
de RRHH, teníamos el compromiso de fomentar bue-
nas prácticas entre nuestros proveedores. Entonces
trabajamos con nuestra área de Compras nuestra
política de elegir trabajar con proveedores ABE. Así,
pasamos a invitar a nuestros proveedores a familiari-
zarse con la Asociación.
Six years ago, AmCham invited my company to be
part of the Association of Good Employers (ABE). I
was interested, and became one of the founding
partners. Once associated, we saw that besides
worrying about our Human Resources area, we
had the commitment to foster good practices

Por ello, en ABE buscamos innovar en la
difusión de prácticas y reconocimiento a
quienes las cumplen. El Sello de Certifica-
ción ABE podrá utilizarse para las publica-
ciones internas y externas de la empresa, y
tendrá 3 versiones de acuerdo a los 3 tipos
de asociados que tenemos, Emprendedor,
Promotor y Master.
El próximo año además, tendremos la pri-
mera edición de nuestra premiación ABE.
Premiaremos a las empresas que además
de cumplir con la ley aplican la Capacita-
ción, la Meritocracia, el Respeto hacia sus
trabajadores y el Reconocimiento y la Re-
troalimentación. En el primer semestre se
hará la convocatoria y publicación de las
bases y estimamos que la premiación será

Para terminar, quiero reafirmar el compro-
