GENERAL COMMENT:
By mandate of Article 200 of the Political Constitution of the Republic, the Supreme Court of
Justice shall act as Court of Cassation and will no longer be a Court of Appeals.
THE GOVERNMENT SUPREME COUNCIL
Preamble:
Whereas, the collusion action was established with the purpose of prosecuting and punishing
fraudulent acts between two or more people intended to cause harm to third parties, and that for
this reason, the Law for the Prosecution of Collusion was issued with special procedures and
jurisdiction;
Whereas, it is necessary to facilitate the exercise of a collusion action by granting jurisdiction to
the superior courts for the respective prosecution;
Whereas, in order to ensure the right of defense, the relevant appeal procedure must be
established;
Given the favorable report from the Legislative Commission; and
In exercise of the authority vested in it,
It decrees as follows:
THE LAW FOR THE PROSECUTION OF COLLUSION IS ISSUED.
Art. 1.- Any person who has suffered harm, in any way, by a collusive procedure or act, e.g., if
he/she has been deprived of the ownership, possession or occupancy of a piece of real property,
or of any right in rem of use, usufruct, occupancy, easement or antichresis over such piece of real
property or other rights that are legally due to such person, may file an action before the civil and
commercial judge of the domicile of any of the defendants.

Art. 2.- Having brought the claim before the respective civil and commercial judge, such judge
shall try the case until a judgment is issued.

Art. 3.- Having qualified the complaint, the civil and commercial judge shall order that the
defendants be served notice so that they may answer within six days.

Art. 4.- Once the period to answer the complaint has elapsed, and whether or not the complaint
has been answered, the civil and commercial judge shall call a conciliation hearing, scheduling
the day, date and time, and such procedure shall take place as provided for in the Code of Civil
Procedure.

Art. 5.- Once the conciliation hearing has taken place and if the proceedings continue, the judge
shall grant a ten day period for evidence. The judge shall request the record of the proceedings
where the collusion allegedly played a role, as well as that of the associated proceedings, if any,
and shall order, ex officio or at the request of the interested party, any evidence that deemed
necessary for clarification of facts.
If the requested proceedings are ongoing, a copy shall be requested.

3. Art. 6.- The judge shall issue the decision within a period of fifteen days. If the grounds for the
claim are confirmed, measures to void the collusive proceeding will be issued, invalidating the
act or acts, and contract or contracts affected by it, as the case may be, and redressing the harm
caused, by restoring to the affected party the possession or holding of the property in question, or
the enjoyment of the respective right, and, as a general matter, restoring the things to the state
prior to the collusion.
If the lawsuit was brought also against judges and attorneys, and there is proof that they
participated maliciously, the judge shall forward copies of the court file to the Judiciary Council
to initiate proceedings for removal from office or suspension of the professional practice, as the
case may be, without detriment to sentencing them to joint payment of compensation for
damages.
Once the judgment becomes final and enforceable, the damages amount shall be liquidated by
the trial court, in a separate record. Once the amount has been determined, it shall be collected by
attachment order.

Art. 7.- The affected party may bring a private criminal action seeking a punishment ranging
from one month to a year of imprisonment for those responsible for the collusion. The statute of
limitations period for such action shall begin on the day on which the judgment in civil
proceedings became final and enforceable.

Art. 8,. The decision issued by the trial court may be appealed before the Provincial Court, which
must issue a judgment based on the court records within fifteen days.
The decision issued by the civil chamber of the provincial court may be appealed by means of
cassation appeal before the respective chamber of the National Court of Justice.

Art. 9.- When the lawsuit is malicious, the plaintiff shall be sentenced to pay compensation for
damages and court costs, and shall receive a punishment set for plaintiffs that cannot prove their
accusation, reserving the right of the offended party to bring a criminal action for slander.

4. Art. 10.- The action granted by this Law prescribes in five years, counting from the date of the
perpetration of the collusive act.

Art. 12.- For anything not expressly stated in this Law, the provisions in the Code of Civil
Procedure and the Code of Criminal Procedure shall apply.
Transitory Provision
Lawsuits for collusive acts that are currently ongoing before the Supreme Court of Justice shall
continue to be tried, and shall be adjudged in the relevant Chamber of the Supreme Court that
hear them.
Final Provisions
First.- The codification of the Law for the Prosecution of Collusion enacted by the Legislative
Commission on February 19, 1959, published in Official Register supplement No. 1202, of
August, 1960, and other legal provisions in opposition to it are hereby expressly repealed.
SECOND.- The Minister of Government and Justice is hereby charged with the enforcement of
this Law, which shall become effective from its enactment in the Official Register.

NOTA GENERAL:
Por mandato del Artículo 200 de la Constitución Política de la República, la Corte Suprema de
Justicia actuará como Corte de Casación, dejando de ser Corte de Apelación.
EL CONSEJO SUPREMO DE GOBIERNO
Considerando:
Que, la acción de colusión fue establecida con el objeto de juzgar y sancionar procedimientos
fraudulentos entre dos o más personas, efectuados para causar perjuicios a terceros, para cuyo fin
se dictó la Ley para el juzgamiento de la Colusión, con trámite y competencia especiales;
Que, es necesario facilitar el ejercicio de la acción de colusión, concediendo competencia para el
respectivo juzgamiento a las cortes superiores;
Que, para garantizar el derecho de defensa, es conveniente establecer el recurso de apelación;
Visto el informe favorable de la Comisión de Legislación; y,
En uso de las facultades de que se halla investido.
Decreta:
EXPIDESE LA PRESENTE LEY PARA EL JUZGAMIENTO DE LA COLUSION
Art. 1.- El que mediante algún procedimiento o acto colusorio hubiere sido perjudicado en cualquier
forma, como entre otros, en el caso de privársele del dominio, posesión o tenencia de algún
inmueble, o de algún derecho real de uso, usufructo, habitación, servidumbre o anticresis constituido
sobre un inmueble o de otros derechos que legalmente le competen, podrá acudir con su demanda
ante la jueza o juez de lo civil y mercantil del domicilio de cualquiera de los demandados.

Art. 2.- Presentada la demanda ante la respectiva jueza o juez de lo civil y mercantil, la sustanciará
hasta ponerla en estado de sentencia.

Art. 3.- La jueza o juez de lo civil y mercantil luego de calificar la demanda, ordenará que se cite a
los demandados para que la contesten en el término de seis días.

Art. 4.- Vencido el término de contestar la demanda, haya o no contestación, la jueza o juez de lo
civil y mercantil convocará a junta de conciliación con señalamiento de día, fecha y hora, diligencia
que se cumplirá conforme a las normas previstas en el Código de Procedimiento Civil.

Art. 5.- Realizada la junta de conciliación, caso de continuarse el juicio, la jueza o juez concederá el
término de diez días para la prueba; pedirá entonces el juicio en que se pretende haber incidido la
colusión, y los procesos conexos, si los hubiere, y ordenará, de oficio o a petición de parte, las
pruebas que estimare procedentes para el esclarecimiento de los hechos.
Si los procesos pedidos estuvieren en trámite, se ordenará conferir copia.

Art. 6.- La jueza o juez expedirá el fallo dentro del término de quince días. De encontrar fundada la
demanda, se dictarán las medidas para que quede sin efecto el procedimiento colusorio, anulando el
o los actos, contrato o contratos que estuvieren afectados por el, según el caso, y se reparen los
daños y perjuicios ocasionados, restituyéndose al perjudicado la posesión o tenencia de los bienes
de que se trate, o el goce del derecho respectivo, y, de manera general, reponiendo las cosas al
estado anterior de la colusión.
Si la demanda se hubiere dirigido también contra los jueces y abogados, y se probare que han
intervenido maliciosamente, la jueza o juez remitirá copias del expediente al Consejo de la Judicatura
para que se inicien los expedientes de destitución o de suspensión del ejercicio profesional, según
sea el caso, sin perjuicio de condenarlos, a unos y a otros, al pago solidario de los daños y perjuicios

7. ocasionados.
Ejecutoriada la sentencia se liquidarán los daños y perjuicios ante el tribunal de primera instancia, en
cuaderno separado. Determinado el monto, se lo cobrará con apremio real.

Art. 7.- El afectado podrá iniciar la correspondiente acción penal privada, para que se imponga a los
responsables de la colusión la pena de un mes a un año de prisión por el cometimiento de la
colusión. El plazo de prescripción de la acción comenzará a correr desde el día en que se ejecutoríe
la sentencia en el juicio civil.

Art. 8.- Del fallo expedido en primera instancia se concederá recurso de apelación para ante la Corte
Provincial, la que fallará, por el mérito de los autos, dentro de quince días.
Del fallo dictado por la sala de lo civil de la corte provincial, se podrá interponer recurso de casación
para ante la respectiva sala de la Corte Nacional de Justicia.

Art. 9.- Cuando la demanda resultare maliciosa, el actor será condenado al pago de daños y
perjuicios y costas, así como a la sanción establecida para el acusador que no ha comprobado su
acusación, dejando a salvo el derecho del ofendido de proponer la acción penal por injuria
calumniosa.

Art. 10.- La acción que concede esta Ley prescribe en cinco años, contados desde la fecha de la
perpetración del hecho colusorio.

Art. 12.- En todo lo que no estuviere expresamente prescrito en esta Ley, se aplicarán las
disposiciones de los Códigos de Procedimiento Civil y de Procedimiento Penal.
Disposición Transitoria
Los juicios por colusión que actualmente se encuentran en trámite en la Corte Suprema de Justicia
continuarán sustanciándose, y serán sentenciados por las respectivas Salas del Tribunal Supremo
que conocen de ellos.
Disposiciones Finales
PRIMERA.- Deróganse expresamente la codificación de la Ley para el juzgamiento de la Colusión,
efectuada por la Comisión Legislativa el 19 de febrero de 1959, publicada en el suplemento del

8. Registro Oficial No. 1202 de 20 de agosto de 1960 , y las demás disposiciones legales que se le
opongan.
SEGUNDA.- De la ejecución de la presente Ley, que entrará en vigencia desde su promulgación en
el Registro Oficial, encárguese el señor Ministro de Gobierno y Justicia.
