Bill of rights

2. La Carta de Derechos o Bill Of Rights fue
aprobada por Guillermo III de Orange, el cual
cuando subió al trono de Inglaterra tras una
serie de guerras por esta corona, lo juró en
1689; en esta Carta de Derechos se modificaron
algunas leyes entre las que están:
• Existe una libertad individual ante la justicia
(no se juzga por estamento)
• Hay una división de poderes, donde el
ejecutivo es el Rey, el legislativo es el
Parlamento y el judicial son los jueces que
pertenecen a la nobleza.
Este proceso de abertura liberal de Inglaterra es
un buen ejemplo de la aplicación de las ideas
ilustradas.
3. BÚSQUEDA DE LA FELICIDAD
Los cuidadanos del tercer estado (campesinos, burguesía,
artesanos…) tenían en mente la violación británica de los
derechos civiles.
Ellos exigieron una Carta de Derechos en la que:
1. Hubiese una libertad individual ante la justicia.
2. Hubiese libertad religiosa para expresar libremente sus
creencias.
3. Todos los hombres y mujeres son libres y con derecho a la
libertad y felicidad.
4. Todo gobernante tiene que respetar los derechos de libertad
y felicidad, si no fuese así, el pueblo podría levantarse en
armas contra el Rey.
-Gracias a esto, el descontento popular va descendiendo ( muy
lentamente) y empiezan a sentir que hay una igualdad entre
estamentos y comienzan a ser un poco más libres.
4. Derechos fundamentales
Se aprobaron algunos derechos que reclamaban los ciudadanos como:
1.El derecho de libertad de discurso, prensa, religión, asamblea
pacifista y el derecho a pedir cambio de gobierno.
2.El derecho de portar armas (el derecho de poseer armas o revólveres,
aunque sujeto a ciertas regulaciones).
3.El gobierno no puede desmembrar casas o habitar a soldados en los
hogares de la gente durante tiempos de paz sin el permiso explícito de
la gente.
4.El gobierno no puede buscar o tomar las propiedades personales sin
una orden judicial.
5.No se puede juzgar a una persona dos veces por el mismo crimen y no
se le puede forzar a que testifique contra él/ella misma.
6.Una persona acusada de un crimen todavía tiene algunos derechos, tal
como el derecho a una audiencia judicial y el derecho de tener un
abogado.
7.Todos/as tienen derecho a ser libres y felices.
8Se protege a la gente contra multas irrazonables o castigos crueles y
excesivos.
9.Se produce la División de Poderes que el pueblo pedía.
5. Se pretende cambiar a los países a nivel económico, agrario,
educativo… a través de reformas ilustradas dirigidas por ilustrados
o intelectuales.
Estas reformas se resumen en todo para el pueblo pero sin el
pueblo.
Existen una serie de reformas sin tocar el poder absoluto, bajo la
razón y la modernidad.
Algunos Reyes Ilustrados fueron:
A. Federico II de Prusia.
B. Catalina de Prusia.
C. Carlos III de España.
Hubo algunos movimientos contradictorios como:
1. Pretende reformar el sistema económico mediante reformas
agrícolas y educativas
2. Se mantiene la estructura política absoluta y estamental,
provocando las posteriores revoluciones francesas, nacionales y
liberales del siglo XIX.
6. Se limitó el poder del Rey mediante
parlamentos.
El poder real estaba limitado en cuanto a la
petición de impuestos y la declaración de las
guerras, estas dos excepciones debían ser
aprobadas por las cámaras:
A. Lores: Nobleza y el clero (privilegiados)
B. Comunes: Burguesía
Con todos estos cambios se limitó un poco el poder
del Rey, otra petición que pidió el pueblo, ya
que antes no tenía ningún tipo de limitación y
realizaba modificaciones en las leyes que
perjudicaban al pueblo.

8. Bill of Rights was approved by Guillermo III de
Orange, who when he became the England king
after some wars for this crown, he sweared it in
1689; in the Bill of Rights some laws was modified
like:
It exists an individual freedom before the justice
(is not judged for estate)
There is a power’s division, where the executive is
the king, the legislative is the Parliament and the
judicial one they are the judges who belong to the
nobility.
This process of liberal England opening is a good
example of the application of the illustrated ideas.
9. Pursuit of happiness
The citizens of the third estate (peasants, middle class,
craftsmen…) they had in mind the British violation of the
civil laws.
They demanded a Bill of Rights in that:
1. There was an individual freedom before the justice.
2. There was religious freedom to express freely his
beliefs.
3. All the men and women have to be free and with right to
the freedom and happiness.
4. Quite governing has to respect the rights of freedom
and happiness, if he wasn’t like taht, the people might
rise up in arms against the king.
Thanks to this the popular dissatisfaction is descending
(very slowly) and they started feeling that there was an
equality among estates and began to be a bit free
10. Fundamental laws There were approved some rights that the citizens were claiming as:
1. The right of freedom of speech, press, religion, pacifist assembly and
the right to ask for changes of government.
2. The right to carry weapon(though it hold to certain regulations).
3. The government can’t dismember houses or reside soldiers in the
homes of the people during times of peace without the explicit
permission of the people.
4. The government can’t search or take the personal properties without a
judicial order.
5. It is not possible to judge a person two times for the same crime and
he can’t be forced that he/she attests against him/her.
6. The same person accused of a crime still (yet) has some rights like the
right to a judicial hearing and the right to have an attorney.
7. They have right to be free and happy.
8. The people are protected against unreasonable fines or cruek and
excessive punishments
9. It is produced the Division of Powers for that the people was asking.
12. It is tried to change to the countries to economic, agrarian,
educational level … across illustrated reforms directed by
illustrated or intellectual people.
These reforms are summarized in everything for the
people(village) but without the people(village).
A series of reforms exist without touching the absolute power,
under the reason and the modernity.
Some illustrated Kings were:
-Federico II of Prussia.
-Catalina of Prussia.
-Carlos III of Spain.
There were some contradictory movements as:
1. It tries to reform the economic system by means of
agricultural and educational reforms
2. There is kept the political absolute structure and estates,
causing the later(posterior) French, national and liberal
revolutions of the 19th century.
13. DIVISION OF POWERS
The power of the King was limited by means of
parliaments.
The royal(real) power was limited as for the request
of taxes and the declaration of the wars, these two
exceptions must be passed for the
chambers(cameras):
-Lores: Nobility and the clergy (favoured)
-Common: Middle class
With all these changes the power of the King was
limited a bit, another request for that the people
asked, since before it did not have any type of
limitation and realized modifications in the laws that
were harming the people(village).
