Through the publication of new regulations regarding Income
Tax, the authorities have established a new option for making
lease payments deductible for dwellings.
Among the changes carried out we find that the requirement for
having the authorization from the authorities to be able to deduct
the aforementioned items has been eliminated.
It establishes that a notice must be filed under oath in which the
information that is submitted is true and reflects the facts, actions,
and transactions of the taxpayer. The notice must be filed in
the Tax Administration Service [in Spanish: el Servicio de
Administración Tributaria] no later than the last day of the tax year
in which you expect to apply the deduction for the first time.
The requirements that allow for the aforementioned deduction
are:
• A copy of the lease agreement.
• A comparative study between the expenditures incurred
during the last tax year with respect to the Tax
Administration Service or for lodging, and the estimated
expenditures during the tax year for the leased dwellings.
Documentation that confirms the time stayed by individuals
in the said property (copy of electricity, phone, or water bill,
etc.).
To claim a deduction in the following tax years, the taxpayer must
keep that part of the accounting documents that proves that the
assets are used exclusively for the activity.
The change that has been referenced to in this newsletter is a
simplification measure upon which authorization from the
authorities is not necessary. Nevertheless, we must comply with
all tax requirements that apply to any expense.

A través de la publicación del nuevo Reglamento de la Ley del
Impuesto Sobre la Renta, la autoridad establece una nueva opción
de poder hacer deducible los pagos por arrendamiento de casas
habitación.
Entre las modificaciones realizadas, podemos encontrar que se
elimina el requisito de contar con la autorización por parte de la
autoridad para poder deducir dichos conceptos.
Se establece, que se deberá presentar un aviso, bajo protesta de
decir verdad que la información presentada es cierta y refleja los
hechos, actos y operaciones que realiza el contribuyente. El aviso
deberá presentarse ante el Servicio de Administración Tributaria
a más tardar el último día del ejercicio en que se pretenda aplicar
la deducción por primera vez.
Los requisitos para poder acceder a dicha deducción son:
• Copia del contrato de arrendamiento.
• Estudio comparativo entre los gastos efectuados durante el
último ejercicio por concepto de hospedaje y las erogaciones
estimadas durante un ejercicio por el arrendamiento de todas
las casas habitación.
La documentación que acredite la estancia de las personas
que ocupan dicho inmueble, (copia del recibo de luz, teléfono,
agua, etc.,).
Para realizar la deducción en los ejercicios siguientes, el
contribuyente deberá conservar como parte de su contabilidad la
documentación con la que acredite que los bienes se utilizan por
necesidades especiales de la actividad.
El cambio al que se hace referencia en este boletín, es una medida
de simplificación al no ser necesaria la autorización por parte de
la autoridad, sin embargo, debemos de cumplir con todos los
requisitos fiscales aplicables a cualquier gasto.
